Heart & Stroke Foundation of Canada Waiver
Thank you for joining with the Heart and Stroke Foundation of Canada ("Heart & Stroke" or the "Foundation") to fundraise as part of our “Fundraise Your Way” campaign. As a fundraiser for Heart & Stroke, you have joined a team of thousands of dedicated people who support the Foundation's mission of preventing disease, saving lives and promoting recovery.
As part of the Digital Peer to Peer campaign, you will be fundraising for and on behalf of Heart & Stroke. By clicking on the I AGREE button you (the "Online Fundraiser", “you”, your”) are confirming that you have read, fully understand and willingly agree to abide by the terms and conditions outlined below, in addition to our Terms of Use and Privacy Policy. ONLINE FUNDRAISING
In order to fundraise for Heart & Stroke, you must register and create an account online at www.fundraiseyourway.ca.
In fundraising for Heart & Stroke, you will have the opportunity to send fundraising emails to friends and family and post about Heart & Stroke through your social media accounts. Heart & Stroke will provide you with templates that you may use, but you are solely responsible and liable for any emails you send and posts you make.
In sending emails and other electronic messages, you agree to comply with Canada’s anti-spam legislation, as applicable.
FUNDRAISING ACTIVITIES or EVENTS
As an Online Fundraiser for Heart & Stroke, you may choose to organize an activity or event (“Event”) for your friends and family to increase donations. All fundraising, whether or not related to an Event, must be done online. Cash and Cheques should not be collected.
If Heart & Stroke will be assisting you in creating a webpage for your Event, an Online Fundraiser registration must be submitted for review and approval by a Heart & Stroke representative before creating the fundraising webpage.
Heart & Stroke reserves the right to reject any Event that is considered incompatible with Heart & Stroke's values or image or which may be deemed deleterious to our brand.
No agreements or contracts must be entered into using Heart & Stroke's name, nor should you attempt to obligate Heart & Stroke in any way without prior written approval from Heart & Stroke.
The Event must be carried out in compliance with all applicable laws, rules and regulations of any applicable governing body. You may respond to queries relevant to the Event, but any inquiries relating to Heart & Stroke must be forwarded to Heart & Stroke. Heart & Stroke cannot provide insurance coverage for Events. You confirm that if required and at your own expense, adequate insurance will be obtained for the Event.
You ACKNOWLEDGE and UNDERSTAND that it is your responsibility to monitor the situation around COVID-19 and comply with government recommendations and restrictions when organizing and running an Event.
PRIVACY
We are committed to protecting the privacy of your personal information. We may maintain a record and share details of your interaction and contact information for donor-related, promotion, follow-up and tax receipting purposes, where required. Occasionally, we may contact you with mission-related or program related communications. If you wish no further contact or have any questions or concerns
regarding the privacy of your personal information, please contact the Privacy Officer at 1-888-HSF-INFO (473-4636) or through www.heartandstroke.ca/privacy.
WAIVER OF LIABILITY
YOU HEREBY ACCEPT ALL RISKS AND ASSUME ALL RESPONSIBILITY, FOR ANY LOSSES, COSTS, AND/OR DAMAGES FOR ANY INJURY SUFFERED BY YOU OR TO YOUR PROPERTY BY ANY MEANS AND HOWSOEVER CAUSED EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF HEART AND
STROKE, WHILE ORGANIZING OR PARTICIPATING IN AN EVENT OR IN THE DIGITAL PEER TO PEER CAMPAIGN;
Heart & Stroke does not assume any type of liability whatsoever for or related to an Event. You agree on behalf of your executors, administrators, assigns, successors, heirs and/or legal or personal representatives TO HOLD HARMLESS AND TO INDEMNIFY Heart & Stroke, its affiliates, officers, trustees, agents, employees, and representatives, successors and entities from all claims and/or liabilities for any
loss, bodily injury, damage, expense or inconvenience that you may suffer as a result of an Event howsoever caused.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS WAIVER AND RELEASE AGREEMENT, FULLY UNDERSTAND ITS TERMS AND CONDITIONS, UNDERSTAND THAT YOU HAVE GIVEN UP SUBSTANTIAL RIGHTS BY ACCEPTING THE TERMS OF THIS WAIVER AND RELEASE AGREEMENT, ACCEPTING IT FREELY AND WITHOUT ANY INFLUENCE, INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
